Terms and Conditions

 

George's Gourmet Foods aims to give you a superb home shopping service. We have set out below the guidelines to let you know what you can expect from us and see the terms on which you place your order.  If you have any queries please let us know, by using the feedback form.

"You" and "Your" means the person ordering Goods from George's Gourmet Foods, who must be over 18 years of age.

"George's Gourmet Foods" or "We" or "Us" or "Our" means George's Gourmet Foods located at 18 Langdale, Singleton, Ashford, Kent, TN23 4YZ.

"Site" means any of Our websites at www.georgesgourmetfoods.co.uk, or www.rxs-enterprises.org/gourmet/

1 Becoming a Customer

1.1 To register as a customer You must be over 18 years of age and live in Our delivery area.

1.2 When You register You will be given a unique Logon Name and You will choose a Password which You must use whenever You shop with Us. Please keep these in a safe place.

1.3 We reserve the right to decline a new customer registration or to cancel registration at any time.

2 Our Contract and the Goods

2.1 Our site invites You to buy goods from Us. A legally binding contract with You will only arise once We have delivered the goods and You have paid for them.

2.2 These terms regulate the supply of goods to You by George's Gourmet Foods. Any other terms, conditions or representations (other than those made fraudulently or implied by statute) are excluded.

3 Price

3.1 All prices displayed on Our Site are intended only as guides.  The price charged will be that in force on the day of delivery.  Prices are clearly marked on the product containers at delivery.

3.2 If you are unhappy with the price once Your order is delivered You may refuse to accept the product.

3.3 There are no delivery charges.

3.4 All products must be paid for at delivery.

3.5 All prices quoted are inclusive of any Value Added or other tax that may be applicable.

4 No Excuses Guaranteed

4.1 At any time up to 4pm on the day before Your order is to be delivered You may change Your mind about purchasing the goods and withdraw or change Your order. There is no charge for doing this. Simply email Us and amend or cancel Your order or call Our Customer Services shown on the Site with Your customer Logon Name.

4.2 If the quality of any of Our products is not to Our usual high standards We will happily refund the money. Please tell Us as soon as possible after You receive the goods by either calling Our Customer Services shown on the Site or e-mail Us using the feedback form. You must store the goods in the manner appropriate to the type of goods (eg keep frozen items frozen) as We may require them to be returned and they must be returned to Us in the same condition as they Were delivered to You.

4.3 If You return goods or cancel Your order under clause 4.1 or 4.2. We will reimburse any sum received from You within 30 days.

5 Stock Shortages

5.1 You will be given the opportunity when You confirm Your order to tell Us whether you would like Us to substitute an alternative similar product if Your chosen goods are not in stock at the time We dispatch Your order. If when You receive Your order, You are not happy with the substitution, please let Us know as soon as You can so that We may handle this in accordance with clause 4.2.

6 Delivering Your Goods

6.1 We always aim to deliver Your goods within the delivery slot We have agreed with You, but We cannot accept liability if We fail to do so.

6.2 Ownership of, and risk in, the goods will pass to You once they have been delivered to You.

6.3 We can only deliver to Your registered address.

6.4 If there is no one at the delivery address who is 18 years of age or over, We'll leave notification of Our visit and will return the goods to Our depot. We'll then contact You to arrange re- delivery at a convenient time.

6.5 Due to licensing restrictions We can only deliver alcohol during the licensing hours that are within Our delivery times. These are currently 8am - 10pm Monday to Saturday and 10am - 10pm Sunday.

6.6 We only deliver to addresses within Kent.  Exceptionally, deliveries of Bulk orders (a Bulk order has a minimum value of £200.00) will be made to addresses in Essex, Surrey and South East London.

7 What We are Not Liable For

7.1 Whilst We take every care to deliver Your order We cannot be liable for any indirect or consequential loss or damage or loss of profits arising out of Our supply or failure to supply the goods to You.

7.2 Clause 7.1 does not in any way limit Our liability for death or personal injury resulting from Our negligence nor limit any statutory rights You have as a consumer.

8 Governing Law

9.1 This contract is subject to English law and the exclusive jurisdiction of the English courts.

9 Changes to these Terms

9.1 If We make any changes to these terms We will let you know as soon a possible by posting the changes on Our Site – and we will update the date shown below.
